Bill C-304 Passes Third Reading

While it isn't much of a surprise given the composition of the senate, Bill C-304 passed third reading and, as a result, Section 13 of the Human Rights Act dealing with hate speech has been repealed. And while the racists who often found themselves in trouble as a result of violating Section 13 and their cheerleaders are celebrating, it might just be a case of be careful what you wished for because you just might get it.

While Section 13 has been repealed, the sections in the Criminal Code related to hate speech are still in place. With claims that the government will strengthen the Criminal Code regarding hate speech, those who at one time might have found themselves before the Human Rights Tribunal might now find themselves in a court room with a real chance of jail time. Thought the Tribunal was costly? Try a criminal court case.

And it is of note that while it is the current government who passed the legislation, there's nothing that says a future government might not reinstate Section 13 given that it had been deemed constitutional both in 1990 and more recently in the Whatcott case.

Time will tell and we are very patient. In the meantime, we'll see how things play out.

Paulie Continues To Display White Supremacist Views in Public

Our readers (will not be at all surprised by the above headline) are well aware of Paulie's involvement with the virulently racist Council of Conservative Citizens in the United States. For those who are unfamiliar, here's a brief synopsis:

The Council of Conservative Citizens (CCC) is the modern reincarnation of the old White Citizens Councils, which were formed in the 1950s and 1960s to battle school desegregation in the South. Created in 1985 from the mailing lists of its predecessor organization, the CCC, which initially tried to project a "mainstream" image, has evolved into a crudely white supremacist group whose website has run pictures comparing pop singer Michael Jackson to an ape and referred to blacks as "a retrograde species of humanity." The group's newspaper, Citizens Informer, regularly publishes articles condemning "race mixing," decrying the evils of illegal immigration, and lamenting the decline of white, European civilization.

Condemned 84 Update

Received a tip from a friend:

It looks like Condemned 84 will arrive in Canada on Thursday the 20th, possibly via Montréal. They are playing in Montréal the next night (venue unknown @ the moment).

We know that at least one Montreal bonehead will be there. Alain Letarte, formerly of Montréal Berzerker Boot Boys & arrested in '98 for a string of assaults in that city, is attending.  

The alleged venue in Ontario, Formac Pool Hall, is on the 2nd floor of a strip mall in Burlington (1400 Plains Rd E).  Almost all the other shops there are run by people of colour.  In fact, there's an Indian take-out joint right next to the pool hall entrance.

There's grafitti in the washroom of the pool hall that says "Burlington Boot Boys" & "Oi!" so skinheads of some kind def. frequent the place.  

Condemned 84 have set up a public event page on Facebook and lots of people are talking on there.  My guess is that whoever is bringing them into Canada did not get proper musician's work permits so if CBSA were properly alerted they wouldn't be allowed into the country.

We were sent a follow-up later:

The CBSA has a file open on this and will be looking at stopping Condemned 84 from getting in and watching for boneheads coming up from the U.S.  If you have any further info for them, you can call them at 1-888-502-9060 and give them the reference # B1061314.

We noted yesterday that the big "Occupy South African Embassies" protest in Toronto was sort of a bust. However Paulie, needing to polish yet another turd, begs to differ:

Another Bonehead Protest Goes Bust

Ever hear of the Renaissance Party of North America? No? Not a surprise. It's yet another fringe white supremacist group with intellectual pretensions. The following are excerpts from their mission statement:

In any case, the leadership of the Renaissance Party of North America decided yesterday they would make themselves known as a force in Canadian politics by staging a massive protest outside the South African consulate in Toronto while referring to their event as "Occupy South African Embassies." One might wonder why then they did not protest at the actual embassy in Ottawa given the name they chose for it, but who are we to judge? They created a Facebook group to promote the event and invited hundreds of people:

Paulie Won't Be Eating Cheerios For a While

We would like to present to you, our dear readers, a cereal commercial that has become infamous in certain circles.

That's right. We wrote "infamous" and "cereal commercial" in the same sentence.



Did you see it! Pure propaganda!

Well, not really. Aside from the fact that this writer finds Cheerios unpalatable unless covered with sugar, thus sort of making any health benefits (dubious though the claims may be) moot, it's a innocuous advertisement featuring actors portraying an attractive, happy, family. The little girl is adorable. The man and woman look like they can be your neighbour. Really, only a diseased mind can find this commercially offensive.

Ladies and gentlemen, let us introduce you to one of those diseased minds:

There are no, "protests." Just a bunch of trolls online and a few
people calling for a boycott of Cheerios for the apparent slight.

Yeah, we don't know if the oddity he's talking about is the couple or the child (or more than likely both), but wow, talk about an ego. Paulie really, truly, believes that this is a cog in the conspiracy to allow "da ethnics" to take over North America.

Lemire Cries Uncle

We figure we'll go right to the source in this one:

Marc Lemire throws in the towel

It was only a matter of time after the Supreme Court unanimously upheld civil law controls on hate speech as constitutional in the Whatcott case, but Marc Lemire has finally admitted that his parallel attack on the Canadian Human Rights Act prohibition on Internet hate-speech (s. 13) has been gutted (‘please ignore my legal arguments found at paragraphs 84-115 of my previous Federal Court of Appeal factum’).

The background to this is that even before the SCC’s decision in Whatcott, Justice Mosley of the Federal Court reached the same conclusion in October 2012 and upheld both the finding that Marc Lemire had violated the Human Rights Act by posting online hate and that section 13 was constitutional as per the Supreme Court’s previous findings in their 1990 Taylor decision. Lemire’s appeal of that decision is ongoing and both Lemire and the Canadian Human Rights Commission (CHRC) filed supplementary legal briefs following the Whatcott decision.

Mr. Lemire caves on the now legally (even more) entrenched facts that civil controls on hate speech are reasonable limits on freedom of expression, are justifiable in a free and democratic society, and are a pressing and substantial objective to avoid the serious damage caused as history has shown. Reading bumps on people’s heads to know what their intent was is still out. Hatred and contempt as narrowly defined by the Supreme Court in Taylor have been properly interpreted by human rights tribunals.

What’s left? Not much. Weak arguments that the Tribunal was right and the Federal Court wrong that severance of the financial penalty provisions was the appropriate remedy to any concerns about them. This, despite the fact that the SCC in Whatcott specifically engages in severance of an obsolete and unused descriptive portion of the hate law to bring the Saskatchewan legislation into constitutional compliance (and modern parlance). Scrambling for a twig to latch onto after that but it’s clear the jig is up.

Lemire’s appeal was always frivolous and now following the unanimous Supreme Court decision in Whatcott, I believe it’s just vexatious. The shame is that by not seeking their costs against Lemire for continuing his appeal after the SCC has put the issue to bed, the CHRC is de facto enabling this waste of taxpayer money. All this, because Mr. Lemire wouldn’t mediate a settlement if a cease and desist order was on the table.

In the end, I think it’s safe to say that despite sharing an interest in disseminating homophobic hate propaganda, Bill Whatcott is waaay off Marc Lemire’s Christmas card list. This one, for instance though, would be quite funny.

"Know Your Place!": Misogyny and Racism

When Dr. Henry Morgentaler died on Wednesday at the age of 90, we expected him to be vilified by the usual suspects. Among those who attacked his legacy were boneheads. Most comments made were pretty nasty, as again we would have expected, but many included some variation of the following assertion:


Women are, in the view of boneheads like Winnicki, simply baby factories. That in a nutshell is all women are really worth to the men who predominate in the racist movement. They might try to soften their view of women by using euphemisms about supporting the traditional families and their desire to protect, "white women" from the coloured hordes eager to ravage them, but the reality is that women are only viewed as useful in their genetic potential and their ability to provide an incubator for the future white warriors who will fight, "the upcoming race war." But the woman herself? Her job is simply to bear children and keep her mouth shut.

The simple, and not so hidden secret, is this: as much as they hate people of colour and Jews, boneheads hate women almost as much.
